    To Audit or Not to Audit, That Is The Question

    In 2017, Massachusetts passed its very own Equal Pay Act (MEPA).  To allow employers to recover, MEPA gave employers a long lead time before the Act became effective.  On July 1, 2018, that lead time ended and MEPA took effect.

    While pay differences based on gender have been forbidden in Massachusetts since the final year of World War II, pay for women lagged behind.  The Legislature tried a new approach with MEPA, incentivizing employers to self-evaluate their pay scales, scrutinize the reasons for any differences between men and women in comparable jobs and make adjustments where needed.  This self-evaluation process, or audit, has been recognized as a creative, new approach to try to better level the playing field.  To encourage employers to audit, the Act includes language regarding an affirmative defense to equal pay claims.  Or does it?

    Of course, nothing is simple.  And to help turn dangerous quicksand into merely mud, that old gang from Miricktown (aka the law firm of Mirick, O’Connell, DeMallie & Lougee, LLP), Betsy Landry, Kathi Goulet and attorney Richard Van Nostrand, returns to HRMA after a one-year hiatus.  In their 2018 iteration, they comprise management, human resources and legal counsel at Worcester’s hottest new idea since stealing minor league baseball teams from rival states, “Crafts and Drafts.” 

    C & D’s can’t miss concept?  A combined arts and crafts store and craft brewery – think a double IPA brewed, aged and poured into a clay beer stein thrown, designed and fired by tipsy patrons under the (mostly) watchful eyes of C & D’s crackerjack staff.  (Better hope the liability and worker’s compensation premiums are paid up!)    

    In any event, with the advantage of having C & D’s OFFRED (“Our Final good Faith, Reasonable, self-Evaluation Document”) in hand, you will witness the brain trust at C & D “manage” and litigate its audit, including:

    • debating the pros and cons of whether to conduct one of those “damn fool audits;”
    • sorting their odd mixture of offbeat positions into comparable job groupings;
    • identifying the $$$ outliers;
    • dreaming up “legitimate” rationales for those differences; and  
    • developing a better wage adjustment strategy than “here’s a buck, now go away.”
